1. Acceptance of Terms
By accessing or using the Perceive8 platform, website, API, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity.
2. Service Description
Perceive8 provides an audio intelligence platform that includes:
- Speech-to-text transcription with speaker diarization.
- AI-powered emotion analysis, sentiment scoring, and prosody detection.
- Content intelligence including named entity recognition, topic detection, and moderation.
- Voiceprint-based speaker identification across recordings (biometric feature requiring explicit consent).
- Conversational AI chat over your transcript data.
- An API and web dashboard for accessing all features.
Features and availability may vary by subscription plan.
3. User Accounts
You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use at [email protected].
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation, including privacy laws governing audio recording and biometric data.
- Infringe on the intellectual property or privacy rights of others.
- Upload audio content you do not have the legal right to process, including recordings of individuals without their knowledge or consent where required by law.
- Conduct covert surveillance or record individuals without required notice or consent.
- Attempt to gain unauthorized access to the Service or its underlying systems.
- Reverse engineer, decompile, or extract the underlying AI models or software.
- Interfere with or disrupt the Service or the servers and networks connected to it.
You are solely responsible for ensuring you have the necessary consents and legal basis to upload and process audio through the Service.
5. Audio Data Processing and AI Analysis
By uploading audio to the Service, you grant Perceive8 and its subprocessors a limited license to process that audio solely to provide the requested features. Specifically:
- Audio files are transmitted to third-party AI providers (listed in our Privacy Policy) for processing. Each provider is bound by data processing agreements.
- We do not use your audio data or derived outputs (transcripts, emotion scores, voiceprints) to train AI models.
- Voiceprint (voice embedding) analysis is a biometric processing feature. You must obtain appropriate consents from all individuals whose voice data will be used to create voiceprints before enabling this feature.
- AI-generated outputs (transcripts, emotion scores, analysis results) are provided "as-is." They may contain errors or inaccuracies. Do not rely solely on AI outputs for high-stakes decisions without human review.
- Emotion analysis may constitute profiling under GDPR Art. 22. You are responsible for ensuring you have a lawful basis for any profiling activities and for complying with applicable restrictions.
6. Data Retention and Deletion
We retain your data according to the following schedule:
- Audio files: 90 days from upload, then automatically deleted.
- Transcripts and analysis results: Duration of your account plus 30 days after closure.
- Voiceprints: Until you withdraw consent or delete your account.
- Billing records: 7 years as required by applicable financial regulations (anonymized after account closure).
You may request deletion of your data at any time through your account settings or by contacting [email protected]. Upon account deletion, we will delete or anonymize your personal data within 30 days, subject to legal retention requirements.
7. Intellectual Property
The Service, including its software, design, and documentation, is owned by Perceive8. You retain ownership of the audio content you upload. By using the Service, you grant Perceive8 a limited, non-exclusive, worldwide license to process your content solely to provide the Service. This license terminates when you delete the content or close your account.
8. Payment Terms
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Usage beyond your plan limits will be billed at the applicable overage rate. Payments are processed by Stripe; you agree to Stripe's terms of service in addition to these Terms.
9. Limitation of Liability
To the maximum extent permitted by law, Perceive8 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service. In no event shall our total liability exceed the fees paid by you in the 12 months preceding the claim.
10. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms. You may terminate your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately, and we will delete your data in accordance with our data retention policy described in Section 6.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of the applicable jurisdiction. Nothing in these Terms limits your rights under applicable mandatory consumer or data protection law.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the revised Terms.
